These Terms of Service (“Terms”) govern your purchase and use of products and services offered by WebNine LLC (“WebNine,” “we,” “us,” or “our”). By accessing our website, signing a proposal, or completing checkout, you agree to these Terms.

1) Website Hosting & Ownership Policy

Website Ownership & Platform Hosting

WebNine LLC develops and manages websites across multiple platforms, including GoHighLevel, WordPress, Squarespace, Vercel, and custom-coded environments.

GoHighLevel-Hosted Websites

Websites and automations built within WebNine LLC’s GoHighLevel platform remain active only while the client’s subscription is current. Hosting, CRM access, and automations are tied to WebNine LLC’s agency account. Upon cancellation, hosted access is suspended unless the client requests a transfer to their own GoHighLevel account. A one-time transfer/setup fee may apply for site migration, domain repointing, and technical support.

Externally Hosted or Independent Builds

For sites built on WordPress, Squarespace, Vercel, or custom code, clients retain ownership of the website design and content once all invoices are paid in full. WebNine LLC may continue to provide hosting, maintenance, or SEO services under a monthly plan. If canceled, the client retains full access to their site under their own hosting account or provider.

Hosting Accounts

If WebNine LLC manages hosting on behalf of the client, hosting remains active only while the account is current. Upon cancellation, the client must transfer hosting within 14 days to prevent downtime.

Cancellation Policy

Monthly plans renew automatically until canceled. Cancellations must be submitted in writing (email or form) at least 7 days before the next billing cycle to avoid renewal. All payments made prior to cancellation are non-refundable, and services remain active through the end of the current billing period.

2) Scope of Services

WebNine LLC provides web design, hosting, SEO, CRM automation, content updates, and reporting services. Specific deliverables are detailed in your selected plan or proposal. Work outside scope may require a separate agreement.

3) Subscriptions & Billing

  • By subscribing, you authorize recurring payments via your selected payment method.
  • Price updates apply to new purchases; active subscriptions remain at their current rate unless you elect to change plans.
  • Failed payments may lead to service suspension.

4) Cancellations & Refunds

Cancellations must be submitted in writing at least 7 days before your next billing date. No refunds are issued for partial months or unused time.

5) Client Obligations

Clients agree to provide timely feedback, approvals, and required access credentials. You represent that all provided materials are lawful and owned or licensed for use.

6) Intellectual Property

You retain ownership of content you provide. WebNine LLC retains rights to its proprietary tools, templates, and pre-existing materials. After payment, clients receive a license to use deliverables as outlined in their plan or proposal.

7) Third-Party Services

WebNine LLC may integrate third-party services (e.g., hosting, email, analytics, CRM). These are subject to each provider’s own terms and fees.

8) Data & Privacy

Your use of our services is also governed by our Privacy Policy. You are responsible for compliance on your own sites (e.g., cookie notices, opt-in forms).

9) Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. The exclusive venue for disputes is Miami County, Ohio.
